Important Notice Regarding Text Messaging Data
Everest Acquisitions does not share customer opt-in information, including phone numbers and consent records, with any affiliates or third parties for marketing, promotional, or any other purposes unrelated to providing our direct services. All text messaging originator opt-in data is kept strictly confidential. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We may share information with subcontractors who support our services, such as customer service providers. All other use case categories exclude text messaging originator opt-in data and consent, and that information will not be shared with any third parties.
1. Who We Are and Scope of This Policy
1.1 This Privacy Policy explains how Everest Acquisitions LLC, a Pennsylvania limited liability company ("Everest," "we," "us," or "our"), collects, uses, discloses, retains, and protects personal information.
1.2 This Policy applies to information we collect through everestacquisitions.com and all related websites, landing pages, funnels, forms, scheduling pages, client portals, and dashboards (collectively, the "Site"). It also applies to information collected through our advertisements, emails, text messages, phone calls, video meetings, social media pages, and the marketing and related services we provide (collectively, the "Services").
1.3 This Policy is part of, and is governed by, our Terms of Service. Capitalized terms that are not defined here have the meanings given in the Terms of Service.
1.4 By using the Site or Services, or by providing us with personal information, you acknowledge that you have read and understood this Policy. If you do not agree with it, please do not use the Site or Services.
2. Our Two Roles: Our Own Data and Our Clients' Data
2.1 Everest as a business. When you visit our Site, book a call with us, become our client, or otherwise interact with Everest directly, we decide how your information is used. This Policy governs that information.
2.2 Everest as a service provider to our clients. We run advertising and lead generation campaigns for home service businesses (our "Clients"). When a homeowner or other consumer responds to an ad or fills out a form for one of our Clients, we collect and process that person's information on behalf of the Client and under the Client's instructions. In that situation: (a) the Client is responsible for how it uses that information, and the Client's own privacy policy governs its use; (b) we use that information only to provide Services to that Client, to maintain and improve our Services, to comply with law, and as otherwise described in this Policy; and (c) if you submitted information in response to a Client's ad and want to access, correct, or delete it, or opt out of communications, please contact the Client directly. If you contact us, we will forward your request to the Client when appropriate.
3. Information We Collect
We may collect the following categories of information. The information we collect depends on how you interact with us.
3.1 Information you give us directly:
Identifiers and contact information, such as your name, email address, phone number, mailing address, and business name
Business information, such as your trade, service area, number of crews, revenue range, job sizes, pricing, marketing history, and goals
Information you provide in forms, surveys, qualification questions, applications, and scheduling tools
Project information, if you respond to a Client's ad, such as project type, property address, budget range, timing, and photos
Payment and billing information, such as billing name, billing address, the last four digits and type of your card, and transaction history. Full payment card details are entered directly into, and processed by, our PCI DSS-compliant third-party payment processors, such as Stripe. Everest never receives, stores, or has access to your full card number or security code.
Account credentials and access you grant us to ad accounts, business pages, CRMs, and other platforms
Communications with us, including emails, text messages, chat messages, voicemails, support requests, and feedback
Testimonials, reviews, photos, videos, and other content you submit
Opt-in records for SMS, email, and calls, including the date, time, method, IP address, and consent language
3.2 Calls and meetings. We may record, transcribe, and summarize phone calls and video meetings, including sales calls, onboarding calls, and client meetings. We use third-party recording, transcription, and AI note-taking tools to do this. We will notify you when a call or meeting is being recorded. By continuing the call or meeting after that notice, you consent to its recording, transcription, and analysis. If you do not consent, tell us, and we will stop recording or end the call.
3.3 Information collected automatically:
Device and connection information, such as IP address, browser type, operating system, device identifiers, and approximate location based on IP address
Usage information, such as pages viewed, links clicked, time spent on pages, referring URLs, form interactions, and video views
Information about how you interact with our emails and text messages, such as opens and clicks
Information collected through cookies, pixels, tags, software development kits, and similar technologies (see Section 7)
3.4 Information from third parties:
Advertising platforms, such as Meta (Facebook and Instagram) and Google, including information from lead forms submitted on those platforms and ad performance data
Our Clients, who may give us customer or lead information to use in campaigns (for example, uploading customer lists to create audiences)
CRM, scheduling, payment, and analytics providers we use
Publicly available sources, such as business websites, business directories, licensing databases, and public social media profiles
Referral partners and people who refer you to us
3.5 Sensitive information. We do not intentionally collect sensitive personal information, such as Social Security numbers, health information, or precise geolocation. Please do not send it to us. If we receive it unintentionally, we may delete it.
4. How We Use Information
We may use the information we collect for the following purposes:
4.1 Providing the Services, including building and running ad campaigns, generating and qualifying leads, delivering leads to Clients, scheduling appointments, sending reminders, building funnels and automations, and reporting on performance.
4.2 Communicating with you, including responding to inquiries, scheduling and confirming calls, sending appointment reminders, providing customer support, and sending service-related and administrative messages.
4.3 Marketing, including sending you information about our Services by email, phone, or text message, where permitted by law and consistent with your consent. We will not send promotional text messages without your specific consent.
4.4 Sales and qualification, including evaluating whether our Services are a good fit for your business.
4.5 Payments and billing, including processing transactions, managing accounts, collecting amounts owed, and responding to chargebacks and payment disputes.
4.6 Improving our business, including analyzing call recordings, transcripts, and performance data to train our team, improve our sales and fulfillment processes, develop new Services, and create aggregated or de-identified benchmarks.
4.7 Advertising and measurement, including measuring ad effectiveness, building and optimizing audiences, and retargeting visitors to our Site with our ads.
4.8 Security and fraud prevention, including detecting, preventing, and responding to fraud, abuse, security incidents, and illegal activity.
4.9 Legal and compliance purposes, including keeping consent records, complying with laws and legal process, enforcing our Terms of Service and agreements, and establishing, exercising, or defending legal claims.
4.10 Business transfers, including evaluating or completing a merger, acquisition, financing, reorganization, or sale of assets.
4.11 Any other purpose we describe to you when we collect the information, or with your consent.
4.12 Aggregated and de-identified data. We may create aggregated or de-identified information that cannot reasonably identify you. We may use and share it for any lawful purpose, including in marketing materials and case studies. We will not attempt to re-identify it.
5. Artificial Intelligence and the Tools We Use
5.1 Our use of AI. We use artificial intelligence tools from third-party providers in our business. We use them to:
record, transcribe, and summarize sales calls, onboarding calls, and client meetings;
analyze call transcripts, lead data, and campaign performance to improve our sales and fulfillment;
draft and edit ad copy, scripts, emails, and other marketing content;
generate voiceovers and creative assets for advertisements; and
automate lead follow-up, qualification, and scheduling communications.
5.2 What AI tools may process. Depending on the task, these tools may process your name, business name, contact information, the content of calls and messages, and business information you share with us. We limit the personal information we send to AI tools to what is reasonably needed for the task, and we use business or API versions of these tools where available.
5.3 Training. We have configured the AI tools we use so that your information is not used to train the providers' general AI models.
5.4 No automated decisions with legal effects. We do not use AI to make decisions about you that produce legal or similarly significant effects without human involvement.
5.5 Tools and providers we use. We use the following categories of third-party tools to collect, store, and process information. We may add or replace providers over time, and we will update this list when we do.

6. How We Share Information
We do not sell, rent, or trade your personal information for money. We may share information in the following circumstances:
6.1 Service providers. We share information with vendors who perform services for us. These include hosting, CRM (such as GoHighLevel), payment processing (such as Stripe), email and SMS delivery, scheduling, call recording and transcription, analytics, AI tools, contractors, and professional advisors. They may use the information only to provide services to us and must keep it confidential and secure.
6.2 SMS aggregators and carriers. We share phone numbers and message content with SMS aggregators, providers, and carriers solely to deliver messages you have agreed to receive.
6.3 Our Clients. If you submit information in response to an ad or form we run for a Client, we share that information with that Client so the Client can contact you about the services you asked about.
6.4 Advertising platforms. We may share limited information, such as hashed email addresses or phone numbers, event data, and pixel data, with advertising platforms like Meta and Google. We do this to measure ad performance, build audiences, and show relevant ads. Their own privacy policies govern how these platforms use that information.
6.5 Legal requirements and protection of rights. We may disclose information if we believe in good faith it is necessary to: comply with a law, regulation, subpoena, court order, or other legal process; respond to valid requests from law enforcement or government authorities; enforce our Terms of Service or other agreements; respond to chargebacks or payment disputes; protect the rights, property, or safety of Everest, our Clients, or others; or detect and prevent fraud or security problems.
6.6 Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, information may be transferred as part of that transaction. It would remain subject to protections at least as protective as those in this Policy.
6.7 With your consent. We may share information for other purposes with your consent or at your direction.
6.8 Text messaging data exclusion. All of the categories above exclude text messaging originator opt-in data and consent. That information will not be shared with any third parties, except the aggregators and providers of our text message services.
7. Cookies, Pixels, and Tracking Technologies
7.1 We and our partners use cookies, web beacons, pixels (including the Meta Pixel and Conversions API), tags, and similar technologies. We use them to operate the Site, remember your preferences, analyze traffic, understand how visitors use the Site, measure ad effectiveness, and show you relevant ads on other websites and platforms.
7.2 These technologies may collect your IP address, device information, browser information, pages visited, actions taken on the Site (such as submitting a form or booking a call), and similar information. Third-party partners may combine this information with other information they hold about you.
7.3 Cookie consent. When you first visit the Site, a cookie banner lets you accept or reject non-essential cookies, including analytics and advertising cookies. Strictly necessary cookies needed for the Site to function cannot be turned off. You can change your choice at any time through the cookie settings link in the Site footer.
7.4 Your choices. Most browsers let you refuse or delete cookies through their settings. Disabling cookies may limit some Site features. You can manage ad preferences in your Meta and Google account settings. You can also opt out of interest-based advertising from participating companies through the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org).
7.5 Do Not Track. Some browsers send "Do Not Track" signals. Because there is no common industry standard for responding to these signals, the Site does not currently respond to them. Where required by applicable law, we will honor recognized opt-out preference signals such as Global Privacy Control.
8. SMS Messaging
8.1 Opt-in and consent. You will receive text messages from us only if you have explicitly opted in, such as by checking an unchecked SMS consent box on a web form. We keep timestamped records of all opt-in actions. Consent to receive text messages is not a condition of any purchase.
8.2 Message types. Messages relate to the services you requested and may include appointment confirmations, reminders, rescheduling updates, and customer support. We do not send promotional content without your specific consent.
8.3 Frequency and rates. Message frequency varies based on your interactions with us. Message and data rates may apply.
8.4 Opt-out. You may cancel SMS messages at any time by replying "STOP." You will receive one final message confirming your opt-out, and no further messages will be sent unless you opt in again. We process opt-out requests promptly.
8.5 Help. Reply "HELP" for assistance, or contact us at [email protected] or (610) 665-3990.
8.6 Carriers. Carriers are not liable for delayed or undelivered messages.
8.7 Data protection. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors who support our services, such as customer service providers. All other use case categories exclude text messaging originator opt-in data and consent, and that information will not be shared with any third parties.
8.8 We comply with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and other applicable laws. Our full SMS program terms appear in our Terms of Service.
9. Email Communications
You may unsubscribe from our marketing emails at any time by clicking the "unsubscribe" link in any marketing email. Even after you unsubscribe, we may still send you transactional or relationship messages, such as appointment confirmations, invoices, account notices, and responses to your requests.
10. Data Retention
10.1 We keep personal information for as long as reasonably necessary for the purposes described in this Policy. This includes providing the Services, keeping business and consent records, resolving disputes (including chargebacks), enforcing our agreements, and complying with legal, tax, and accounting obligations.
10.2 We keep SMS and communication consent records for at least as long as required to demonstrate compliance with applicable law. We may keep call recordings, transcripts, and account records for the life of the business relationship and for a reasonable period afterward.
10.3 When we no longer need personal information, we will delete it, de-identify it, or securely store it until deletion is possible.
11. Data Security
11.1 We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, and disclosure. These include access controls, secure login practices, use of reputable service providers, and limiting access to people who need it.
11.2 Payment security. Payments are processed by PCI DSS-compliant third-party payment processors, such as Stripe. Card data is transmitted directly to the processor over encrypted connections and is never stored on Everest's servers or systems.
11.3 However, no method of transmitting data over the internet or storing it electronically is completely secure. We cannot and do not guarantee absolute security. You provide information at your own risk. You are responsible for keeping any passwords and login credentials confidential.
11.4 If a security breach affects your personal information, we will notify you and any applicable authorities as required by law.
12. Your Rights and Choices
12.1 General choices. You may:
Update or correct information you gave us by contacting us
Opt out of marketing emails by clicking "unsubscribe"
Opt out of text messages by replying "STOP"
Ask us to stop calling you for marketing purposes
Manage cookies through your browser settings
Withdraw consent at any time for future communications, which does not affect any processing before you withdrew it
12.2 State privacy rights. Depending on where you live, and to the extent state privacy laws apply to us, you may have additional rights regarding your personal information. These may include the right to:
Know or access the personal information we have about you
Correct inaccurate personal information
Delete personal information
Receive a copy of your personal information in a portable format
Opt out of the "sale" or "sharing" of personal information, or of targeted advertising, as those terms are defined under applicable law. Our use of advertising pixels may be considered "sharing" or targeted advertising under some state laws. You can opt out by rejecting advertising cookies in our cookie banner, by enabling Global Privacy Control in your browser, or by contacting us.

12.3 How to make a request. To exercise any of these rights, including rights under the GDPR (Section 14) or the California Consumer Privacy Act (CCPA) where they apply, email our privacy contact at [email protected] with the subject line "Privacy Request." We will need to verify your identity before fulfilling your request, and we may ask for additional information to do so. You may use an authorized agent to make a request on your behalf. We may require proof of the agent's authority and may ask you to verify your identity directly.
12.4 Limits. We may deny or limit a request where permitted by law. For example, we may do so if we cannot verify your identity, if the information is needed to complete a transaction, keep consent or legal records, respond to a dispute or chargeback, or comply with law, or if the request is excessive or unfounded. If we deny a request, we will explain why, and where required by law, tell you how to appeal. If you are dissatisfied with our response, you may contact the attorney general or consumer protection authority in your state.
12.5 Client lead data. As explained in Section 2.2, if your information was collected on behalf of one of our Clients, please send your request to that Client.
13. Children's Privacy
The Site and Services are intended for adults and businesses. They are not directed to children under 18. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us personal information, contact us and we will delete it.
14. International Users and Visitors from the EEA, UK, and Switzerland
14.1 The Site and Services are operated in the United States and intended for businesses in the United States. If you access them from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.
14.2 Legal bases. If the EU or UK General Data Protection Regulation ("GDPR") applies to our processing of your personal data, we rely on the following legal bases: (a) performance of a contract, to provide the Services and process payments; (b) legitimate interests, to operate and improve our business, market our Services to businesses, keep records, prevent fraud, and defend legal claims, where those interests are not overridden by your rights; (c) consent, for marketing text messages, non-essential cookies, and call recording where consent is required, which you may withdraw at any time; and (d) legal obligation, where we must process data to comply with law.
14.3 Your GDPR rights. Subject to applicable law, you have the right to: access your personal data; correct inaccurate data; erase your data; restrict or object to our processing, including objecting at any time to direct marketing; receive your data in a portable format; withdraw consent; and lodge a complaint with your local data protection supervisory authority. To exercise these rights, contact us as described in Section 12.3.
14.4 Transfers. Where we transfer personal data from the EEA, UK, or Switzerland to the United States, we rely on appropriate safeguards, such as Standard Contractual Clauses or our providers' participation in the EU-U.S. Data Privacy Framework, where applicable.
15. Third-Party Links and Platforms
The Site and our communications may contain links to third-party websites, platforms, and services, such as Meta, Google, scheduling tools, and payment pages. We are not responsible for their privacy practices or content. This Policy applies only to information collected by Everest. We encourage you to review the privacy policies of any third party you interact with.
16. Business-to-Business Information
Much of the information we collect relates to business owners and employees acting in a business capacity. We may use business contact information to communicate with you about our Services and your business, subject to your right to opt out of marketing communications at any time.
17. Changes to This Policy
We may update this Policy from time to time. The updated version will be posted on the Site with a new "Last Updated" date. If we make material changes, we will provide additional notice, such as by email or a notice on the Site. Your continued use of the Site or Services after changes take effect means you accept the updated Policy.
